Which Social Network Companies Have to Comply with the new legislation ?

New liability for Social Network Companies

Linkedin, Quora, Youtube, Twitter, Reddit, Medium, Tumblr, Flickr and other social networks has to determine a responsible person in Turkey in very close future ? Let’s look at the recent developments related to social media companies in Turkey.

Turkey is preparing to enact a new law within the scope of corona virus measures.With this comprehensive law, there are also many new regulations such as determining mandatory responsible in Turkey for Social Network Companies.

What is social network provider ?

According to the draft law, Turkey creates a new liability for Social Network Companies/Providers.

This liability is determining a responsible person in Turkey to respond official institutions demand and questions.

By the way according to the draft law the definition of the social network provider is;

Real or legal persons that enable users to create, view or share data such as text, image, sound, location on the internet for social interaction purposes, (such as Medium, Linkedin, Youtube, may be quora etc. )

Which Social Network Companies/”Providers” Has to Determine a Responsible Person in Turkey ?

Foreign Social networks which has more than one million daily access, has to determine at least one responsible person in Turkey to respond official institutions questions and demands.

Responsible person’s identity and contact information has to submitted to official institutions and also has to show this person’s contact information on the website, which is easily visible and directly accessible.

What if they do not ?

If the representative is not determined within 30 days after the utilization of law, the internet traffic bandwidth of the social network provider will be reduced up to 95 percent.

What about data hosting ?

Even domestic or foreign, which more than a million sourced from Turkey daily access to these social networks, data users in Turkey is obliged to host in Turkey.

In conclusion; not to subject any penalty or access problem I recommend social network companies act proactively.
